29 CFR 1926.20(b)(2): Such programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On 5/02/2018, the subcontractor and three subcontractor employees were installing materials on a roof of a residential building located at 217 Old Ballwin Road in Ballwin, MO. Antonio Yanez, the owner and controlling contractor for the sub-contractor, was at the site and did not conduct an adequate inspection of the job site, materials, and equipment. The following violative conditions existed at the time of the inspection: a) An employee was not wearing eye protection while using a pneumatic nail gun to install shingles. b) An employee and three subcontractor employees were not utilizing guardrail systems, a safety net system, or a personal fall arrest system while installing shingles on a 5/12 sloped roof approximately nine feet above the ground.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On 5/02/2018, Antonio Yanez DBA Antonio Yanez was installing shingles on a roof of a residential building located at 217 Old Ballwin Road in Ballwin, MO. The owner and an employee were not utilizing guardrail systems, a safety net system, or personal fall arrest systems. They were working on the roof of the building without fall protection, exposing them to a fall to the ground below. ANTONIO YANEZ DBA ANTONIO YANEZ was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 907566, citation number 2, item number 1, issued on 7/02/2013 and was affirmed as a final order on 7/29/2013, with respect to a workplace located at 1543 Coachway Lane, Hazelwood, MO 63121.
