OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to being struck-by an excavator: a. On or about April 26th, 2018, at 116 Avenue and SW 11th Street, Miami, FL, the employer failed to protect a worker who was exposed to a struck-by hazard from the operation of an excavator in an area occupied by a pedestrian worker.
