29 CFR 1926.252(a): An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s):    a. 1402 South Ave., Plainfield, NJ    The employer did not ensure that a chute was used for the removal of construction debris from the 2nd and 3rd levels.  An employee cleaning the construction debris was observed throwing materials from the 2nd and 3rd floor deck directly to the ground.    Violation observed on or about May 15, 2018

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. 1402 South Avenue, Plainfield, NJ    Employees engaged in residential framing activities were observed working without the use of fall protection.  Employees were observed working at the edge of the third story deck while installing the plywood decking where guardrails were not completed to protect employees from falls at the balcony areas and other unprotected areas without the use of fall protection.    Violation observed on or about May 15, 2018   Brutus Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1303697, citation number 1, item number 2, and was affirmed as a final order on April 24, 2018, with respect to a workplace located at Crossroads Development,  Building 7, Cross Road & West Moyer Road, Pottstown, PA 19464   Brutus Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1290726, citation number 1, item number 1, and was affirmed as a final order on April 10, 2018, with respect to a workplace located at 11 Pollock Court, Berlin Township, NJ 08091   Brutus Construction, Inc. was previously cited for a WILLFUL violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1294166, citation number 2, item number 1, and was affirmed as a final order on March 22, 2018, with respect to a workplace located at 60 Passaic Avenue, Fairfield, NJ 07004
