29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1:  a. On or about May 14, 2018, in the jobsite at "5 Thousand Town Apartments" project, South wall of the East building, the employer failed to fully and properly implement the engineering controls and work practices described in Table 1, as the employees used a handheld angle grinder for uses other than mortar removal which included, but were not limited, to cut exterior walls decorative features made of concrete and metal mesh, without an integrated water delivery system and without a commercially available shroud and dust collection system for the protection of employees from airborne crystalline Silica dust.

On or about May 14, 2018, in the jobsite at "5 Thousand Town Apartments" project South wall of the East building, the employer did not required employees using a handheld DeWalt DWE402 angle grinder to cut concrete exterior building features to use respiratory protection.   The employer had not fully and properly implement the engineering controls and work practices as described in Table 1.

29 CFR 1926.1153(i)(1): The employer did not ensure that at least the following hazards were addressed: Cancer, lung effects, immune system effects, and kidney effects:  a. On or about May 14, 2018, in the jobsite at "5 Thousand Town Apartments" project South wall of the East building, the employer failed to provide training to employees on the health hazards presented by the exposure to airborne Crystalline Silica to the employees conducting demolition operations that included using a DeWalt DWE402 handheld angle grinder to cut concrete, a task that could expose them to airborne Silica dust.
