29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): 29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. a) During the period between May 25, 2018, and May 29, 2018, the employer engaged in the operation of an all-terrain forklift without ensuring competency to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation. Denali Masonry, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(1)(i) which was contained in OSHA inspection number 983822, citation 1, item 1, and was affirmed as a final order on July 31, 2014, with respect to a worksite located at Hobson and Shamrock, Naperville, Illinois. No abatement certification required for this violation.

29 CFR 1904.39(a)(2): 29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov: a) During the period between May 25, 2018, and May 29, 2018, the employer did not report an in-patient hospitalization that was the result of a work-related incident to OSHA within twenty-four (24) hours for an injury that occurred on May 25, 2018. No abatement certification or documentation is required for this item.
