29 CFR 1910.133(a)(1): The employer did assess the workplace to determine if hazards are present, or likely to be present, which necessitate the use of personal protective equipment (PPE); a) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 17-2018, the employer failed to assess the end use concentration of a caustic cleaning agent to determine if face shields were required during sanitation operations:    (a) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 17, 2018 and at times prior and since, the employer failed to ensure employees use appropriate eye or face protection when exposed to liquid chemicals, specifically acids, such as KC-505, KC-615, and KC-262.  Employees wear loose fitting safety goggles when cleaning with these chemicals during sanitation operations.  SDSs for these chemicals state that employees must wear tight sealing safety googles and/or face shields.      (b) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 21, 2018 and at times prior and since, the employer failed to ensure employees use appropriate eye or face protection when exposed to liquid chemicals, specifically caustic liquids, such as chlorine and sanitation soap.  Employees wear loose fitting safety goggles when cleaning with these chemicals during sanitation operations.  SDSs for these chemicals state that employees must wear tight sealing safety googles.

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid:    (a) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 15, 2018, Employee 1 sustained an eye impact injury from a water key with accompanying headache, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (b) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 21, 2018, Employee 2 got KC-262 soap in an eye, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.        (c) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 21, 2018, Employee 3 sustained a right knee injury in a fall, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (d) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 22, 2018, Employee 4 got dirty cleaning water in right eye with minor burning pain, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (e) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 24, 2018, Employee 5 sustained a right hip injury, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (f) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 26, 2018, Employee 6 sustained a left knee injury in a fall, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (g) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 29, 2018, Employee 7 sustained a chemical burn to the face from soap and bleach, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (h) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 7, 2018, Employee 8 sustained a left lower foot strain, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (i) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 17, 2018, Employee 9 got KC-262 soap in eyes with burning sensation persisting after 10 minutes of eye wash, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.      (j) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about August 21, 2018, Employee 10 got chlorine and soap in eyes with pain, blurry vision, watering, and redness of left eye, was not referred to an infirmary, clinic, or hospital, or treated by a person adequately trained to render first aid.

29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:    (a) Packers Sanitation Services, Inc. at Mountaire in Millsboro, DE - On or about June 8, 2018, Employee 1 suffered a laceration to a finger on the right hand and a supervisor rendered first aid.  The supervisor and employees in the vicinity were potentially exposed to bloodborne pathogens without an established written exposure control plan to eliminate or minimize blood borne pathogens.    ABATEMENT NOTE:    Exposure Control Plan (ECP) must include:     1. The tasks and procedures in which occupational exposure may occur and the positions whose duties include those tasks and procedures identified as having occupational exposure.    2. The procedure for evaluating the circumstances surrounding exposure incidents.    3. Review and update the exposure control plan at least annually (every 12 months) and whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure.    4. Make the hepatitis B vaccination available to employees with occupational exposure to blood or OPIM.
