OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    On or about June 25, 2018 and times prior, the employer did not ensure that the foot pedal mechanisms on press brakes such as but not limited to Diacro 17 ton press brake were guarded to prevent unintended activation of the equipment. An accidental activation of the foot pedals could result in a caught-in, crush-by, and amputation hazards at the point of operation.

29 CFR 1910.303(g)(1)(i)(B): The width of working space in front of the electric equipment shall be the width of the equipment or 762 mm (30 in.), whichever is greater. In all cases, the working space shall permit at least a 90-degree opening of equipment doors or hinged panels:    On or about June 25, 2018 and times prior, a 460 volt electric panel for Niagara 175 ton press brake and a control panel for Cincinnati 60 ton model CB 11, press brake were blocked with parts. This condition made it difficult to access the panels during an emergency situation that required immediate shutdown.
