29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) On or about July 05, 2018 at the vacated Sports Authority building in Sports Authority Village located at 3200 Northlake Parkway in Atlanta, Georgia; two employees were exposed to silica hazards while wet cutting concrete and the employer did not implement their written hazard communication program in that an employee acting in the capacity of helper had not received hazard communication training and an employee acting in the capacity of site superintendent had not been provided effective hazard communication program training. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRETI E ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) a. On or about July 05, 2018 at the vacated Sports Authority building in Sports Authority Village located at 3200 Northlake Parkway in Atlanta, Georgia; an employee acting in the capacity of helper was exposed to silica hazards where the employer did not provide the employee with hazard communication program training and the employee assisted a site superintendent in cutting concrete. b. On or about July 05, 2018 at the vacated Sports Authority building in Sports Authority Village located at 3200 Northlake Parkway in Atlanta, Georgia; an employee acting in the capacity of site superintendent was exposed to silica hazards where the employer did not provide the employee with effective hazard communication program training and the employee performed wet cutting concrete. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRETI E ACTION WORKSHEET).
