29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the forks: a) 5 Gainsboro Dr., Berlin, NJ: On or about July 10, 2018 2 Brutus Construction Inc. an employee was conducting framing work on a new construction two story residence. The employee using sheets of plywood laid across the forks of a Gradall RTFL as a working platform. The platform was not attached to the forks in any manner.

The employee was not using fall protection while walking the exterior wall top plates and was thus exposed to fall hazards of greater than 13 feet to the ground below. The employer, Brutus Construction Inc ., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1290726, citation number 01, item number 01 and was affirmed as a final order on 04/10/2018, with respect to a workplace located at 11 Pollock Court, Berlin, NJ.
