29 CFR 1910.29(b)(13): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening did not meet the requirements (b)(13)(i) or (b)(13)(ii) of this section. On or about 19 July 2018, and at times prior thereto, platform ladderway openings were unguarded at the point of access to the platform, exposing employees to the hazard of falling in excess of more than 4 feet to the pavement below. 1) Southwest Generator Room: A fixed ladder allowed access to a platform approximately 11 feet 6 inches high in which the opening at the ladder was unguarded. 2) Northwest Generator Room: A fixed ladder allowed access to a platform approximately 11 feet 6 inches high in which the opening at the ladder was unguarded. 3) Silo: A fixed ladder allowed access to a platform approximately 13 feet 6 inches high in which the opening at the ladder was unguarded. An additional fixed ladder allowed access to a higher platform approximately 20 feet 6 inches high in which the opening at the ladder was unguarded.

29 CFR 1910.119(e)(3)(v): The process hazard analysis did not address the hazards related to facility siting. On or about 17 July 2018, and at times prior thereto, the process hazard analysis (PHA) for the Acetylene manufacturing and filling process did not include asbestos as a hazard for the purposes of addressing facility siting in the event of a fire and explosion, exposing employees within the plant to the hazards of asbestos-related health issues.

29 CFR 1910.119(n): The emergency action plan did not consider wind direction for the safeguarding of employees during an evacuation due to a release. On 17 July 2017, and at times prior thereto, windsocks were not utilized by the employer as a means to protect employees during an emergency to indicate wind direction in the event of a vapor cloud release, exposing the employees to the hazard of an explosion or fire.

On or about 19 July 2018, and at times prior thereto, employees utilized process piping as an anchor point for fall protection, exposing the employees to a fall hazard of approximately 5 feet 6 inches to the concrete slab.
