29 CFR 1910.119(f)(3): The operating procedures were not reviewed as often as necessary to assure that they reflect current operating practice, including changes that result from changes in process chemicals, technology, and equipment, and changes to facilities. The employer did not annually certify that operating procedures were current and accurate.     On or about July 24, 2018, at the Martin Midstream, L.P. facility located in Plainview, Texas, the employer did not annually certify operating procedures to ensure that they are current and accurate, this includes but is not limited to Ammonium Sulfate Operations, (6/29/12).  The procedure was not annually certified from 2017 through 2018 and was found to be inaccurate.

29 CFR 1910.119(o)(4): The employer did not promptly determine and document an appropriate response to each of the findings of the compliance audit, and document that deficiencies have been corrected:       On or about July 24, 2018, the employer failed to promptly determine and document an appropriate response to each of the findings of the compliance audit, and document that deficiencies have been corrected, this exposed employees to inhalation hazard at Martin Midstream located in Plainview, TX.  This includes but is not limited to the following findings:      a)    Consider reviewing and updating the program documents or element procedures addressing all the elements of the PSM program, as necessary.  b)    Consider implementing the car seal program being developed on a corporate level to ensure that critical block valves are always maintained in the correct position (open or closed).  c)     Consider adopting the corporate deficiency management system or creating a temporary MOC whenever deficiencies in equipment are discovered to ensure that the deficiency situations are managed appropriately.  d)    Consider (1) closing the open action items from the 2008 and 2011 audits as soon as possible and (2) entering the corrective actions from the 2014 audit into the action tracker in the new ERM tool and tracking them to completion.  e)    Implement the draft task-based operating procedures with instructions for safely conducting the activities involved in each process area.   f)     Develop and implement a program to ensure that refresher training on operating procedures occurs at least every three years. The program should include consultation with employees on the frequency of refresher training and provide it more often if recommended.
