OR IN THE ALTERNATIVE:  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) Production Area, 830 Crowe Road, East Stroudsburg, PA - Employees operated a Wastequip Model 7230 Vertical Baler (Serial No. LB 10026) with a modified loading chamber access gate interlock system, exposing employees to caught-in and crushed-by hazards, on or about August 7, 2018.  b) Production Area, 830 Crowe Road, East Stroudsburg, PA - Employees operated a Wastequip Model 7230 Vertical Baler (Serial No. LB 10026) with a loading chamber access gate with a damaged interlock system that did not prevent the ram from cycling while the gate was open, exposing the employees to caught-in and crushed-by hazards, on or about August 7, 2018.  c) Production Area, 830 Crowe Road, East Stroudsburg, PA - Employees operated a Wastequip Model 7230 Vertical Baler (Serial No. LB 10026) with a damaged bale chamber door (bent) that could fail during operation exposing the employees to struck-by hazards, on or about August 7, 2018.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
