29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) SLP Construction LLC Located at 2164 Fountain Circle, Erie, CO 80516: On and Preceding 18 August 2018, the employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles to include but not limited to debris from use of pneumatic nail guns. Employees installing sheathing pieces with a pneumatic nail gun on a residential roof were not utilizing eye or face protection. This exposed the employees to struck by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) SLP Construction LLC Located at 2164 Fountain Circle, Erie, CO 80516: On and Preceding 18 August 2018, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection. Two employees were cutting and installing sheathing the roof near the edge at the peak and another employee was assisting him. The employees did not have harnesses on and anchors were not installed. This exposed the employee to falls from height. b) SLP Construction LLC Located at 2164 Fountain Circle, Erie, CO 80516: On and Preceding 18 August 2018, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection. The interior of the home had a second floor installed which was approximately 9' above ground level. The second floor opened to a 9' the first floor and no method of fall protection was utilized. Fall protection would include but not be limited to a temporary guardrail system. This exposed the employee to falls from height.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: a) SLP Construction LLC Located at 2164 Fountain Circle, Erie, CO 80516: On and Preceding 18 August 2018, The employer did not ensure stairways having four or more risers were equipped with a stairrail system along each unprotected side or edge. Employees engaged in residential construction used the stairs in the main living area to access the second floor of the home while carrying materials and tools. The staircase in the main living area had 16 risers, one side open and the other side had a framed in wall. Neither side had a stairrail system installed. This exposed employees to falls from height.
