29 CFR 1926.454(c)(3): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work, the employer did not retrain each such employee so that the requisite proficiency is regained. Retraining is required because the following situation: Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency: On or about 08/22/2018; Location: Front gazebo under construction; 1) Two employees framing the gazebo in front of the construction site climbed over the rails of a scissor lift basket and were exposed to fall hazards approximately 18ft from ground level, were not retrained to demonstrate safety proficiency while working on a scaffold.
