29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a) a) Front Center of Structure - The ladder used by the workers to gain access to the roof extended approximately 24 inches past the landing surface exposing workers to a fall of approximately 20 feet should displacement occur, on or about 08/24/2018. No abatement certification or documentation required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Front Center Roof of Structure - Three workers replacing the roofing tiles on a large single family home were exposed to a 20 foot fall hazard due to lack of fall protection on or about 08/24/2018. Sam's Home Improvement Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 950844, citation number 1, item number 1 and was affirmed as a final order on 2/28/2014, with respect to a workplace located at 1428 Irving Street NE Washington DC 20017. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
