29 CFR 1910.28(b)(3)(ii): The employer did not ensure each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems:   "Dungeon" (Custodial Staff Office): A metal cover (grating) used to prevent employees from tripping or stepping into the opening of a 3-foot deep sump pump reservoir was not secured to prevent its movement.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) The employer did not maintain a written hazard communication program at the workplace where employees were exposed to hazardous chemicals, including Clorox and ammonia.   (b) Two food service workers had not been provided with information and training (stipulated in 1910.1200(h)(2) and (h)(3)) on hazardous chemicals in their work area or been trained on the new chemical container label elements and the new format and types of information on each section of the Safety Data Sheet, with respect to revisions to the standard in accordance with the Globally Harmonized System of Classification and Labeling of Chemicals (GHS).  Notice #001, Item #003a, 29 CFR 1910.1200(e)(1) as required by 29 CFR 1960.8(b): The employer failed to develop, implement, and maintain a written hazard communication program at the worksite and provide employees with effective information and training. The employer was cited for a violation of the same standard on 02/02/18, Inspection #1278134, 02/28/18 of final order/settlement, and was abated by discontinuing the use of hazardous chemicals.
