29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  (a) Maintenance Building, Exit door located between two roll-up doors: On or about 09/17/2018, and at times prior, the emergency exit door was obstructed and not kept clear in the event of an emergency, in that 55 gallon drums, propane tanks and a pressure washer were placed in front of the door.

29 CFR 1910.110(f)(2)(ii): Containers when stored inside were located near exits, stairways, or in areas normally used or intended for the safe exit of people.  (a) Maintenance Building, Exit door located between two roll-up doors: On or about 09/17/2018, and at times prior, empty forklift propane tanks were stored near the exit, in that the tank created a trip hazard and was not stored in designated areas.

29 CFR 1910.110(e)(4)(iii): Permanent and removable fuel containers were not securely mounted to prevent jarring loose, slipping, or rotating:  (a) Production Department, Bay #1: On or about 09/17/2018, and at times prior, employees were exposed to struck-by hazards while operating a powered industrial truck, in that the strap used to hold the propane tank in place was not secured while the truck was being operated throughout the plant.   (b) Maintenance Building, Outside Roll-up Door: On or about 09/17/2018, and at times prior, employees were exposed to struck-by hazards while powered industrial truck was used in the yard, in that the propane tank was not secured to the propane tank holder on the truck used outside the plant.

29 CFR 1910.217(d)(9)(i): The employer did not establish a die setting procedure for mechanical power press(es) that would ensure compliance with 29 CFR 1910.217(c):  or in the alternative;  Section 5(a)(1) of the OSHA Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards:   a) Bay #1, Mechanical Press 43: On 09/17/2018, employees were exposed to struck-by hazards while repositioning the die set on the Niagra Mechanical Power Press P-43, in that the bolt/clamps were not all attached and checked prior to raising the die assembly.

29 CFR 1910.37(b)(6): Each exit sign was not illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and be distinctive in color:  (a) Die maintenance area, fire exit. On or about 10/17/2018. The employer failed to provide illuminated exit signs in the event of a power outage or fire emergency in the maintenance area.
