OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by material and falling racks. a) Production Department, Bay 3: On February 13, 2020, and at times prior, the employer exposed employees to struck-by hazards in that the storage racks labeled "3W1" and "3W2" had bent/damaged supports.

29 CFR 1910.132(b): Employee-owned equipment: Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance, and sanitation of such equipment: a) Production Area, Bay 3: On February 13, 2020, the employer exposed employees to burn hazards in that the employer did not ensure the adequacy of an employee's protective equipment as they used personally-bought welding sleeves while operating a spot welding machine.
