29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline:  a) Jobsite: The employer did not ensure that water was removed from an excavation before footings and foundation activities were performed.  Condition was observed on or about 24 SEP 2018.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) Jobsite, excavation: The employer does not shore exposed excavation walls that are deeper than 5 feet. This violation was most recently observed at 2010 Walnut Street, Philadelphia on or about September 24, 2018, where employees were performing concrete foundation and footing activities approximately 10 feet from the street level. To abate this ongoing violation, the employer must utilize adequate protective systems at depths deeper than 5 feet.  Condition was observed on or about 24 SEP 2018.  b) Jobsite, elevator pit: The employer does not shore exposed trench walls that are deeper than 5 feet. This violation was most recently noted at 2010 Walnut Street, Philadelphia on or about September 24, 2018, where employees were performing concrete foundation and footing activities for an elevator pit approximately 8 feet below the working surface of the bottom of the excavation. To abate this ongoing violation, the employer must utilize adequate protective systems at depths greater than 5 feet.  Condition was noted on or about 24 SEP 2018.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  a) Jobsite: The employer did not ensure that a safe means of egress was provided within 25 feet of lateral travel in the working area, exposing employees to various hazards associated with not being able to safely egress from an excavation in case of an emergency.   Condition was noted on or about 24 SEP 2018.  Real Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(2) which was contained in OSHA inspection number 957305, citation number 1, item number 2/a, and was affirmed as a final order on 11 APR 14, with respect to a workplace located at 1001 South 17th Street, Philadelphia.

Employees were exposed to caught in-between hazards while conducting footings and foundation installation activities.    Condition was noted on or about 24 SEP 2018.  Real Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(2) which was contained in OSHA inspection number 957305, citation number 1, item number 3, and was affirmed as a final order on 11 APR 14, with respect to a workplace located at 1001 South 17th Street, Philadelphia.
