29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  On or about October 3, 2018, employees working the in the excavation were not provided with a ladder every 25 feet, exposing the employees to the hazards of cave-ins.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.  On or about October 3, 2018, the employer did not ensure that the competent person in charge on site conducted an inspection of the excavation before allowing employees to enter it, exposing the employees to the hazard of a cave-in.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about October 3, 2018, the Werner 24 foot extension was set up in the excavation and was not extended 3 feet above the edge of the excavation, exposing employees to a hazards of approximately 15 feet.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about October 3, 2018, two employees were grading gravel in the bottom of an excavation up to approximately 14 feet and 8 inches deep without an adequate protective system in place, exposing the employees to the hazard of a cave-in.  The UST Systems, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312926215, citation number 1, item number 4 and was affirmed as a final order on July 19, 2011, with respect to a workplace located at or around 1050 IH-10 South, Beaumont, TX 77707.
