29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. On or about October 18, 2018 employees engaged in setup and/or cleaning tasks on cup lines were not trained to implement lockout procedures to prevent employee exposure to potential hazardous energy.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about October 18, 2018 employees were exposed to machine hazards associated with pinch point hazards from moving parts when they are engaged in servicing and maintenance activities on the Cup Lines. The employer did not ensure that energy control application steps to control electrical and/or pneumatic energy sources were implemented prior to allowing employees to start setup and/or cleaning activities on the cup lines. The machine was not shut down or turned off prior to engaging in these servicing and/or maintenance activities. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing and/or maintenance hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.: a) On or about October 18, 2018 the Price Cup Line #5 top lidder magazine was not guarded to prevent a pinch point hazard created by the downward motion of the lidder plates and the machine frame. b) On or about October 18, 2018 the Price Cup Line #5 heat sealer was not guarded to prevent employee exposure to pinch point hazards created by the downward motion of the heater heads and/or plate against the machine frame and/or the cup conveyor. c) On or about October 18, 2018 the pinch point created between the cup conveyor and the lidder press on the Price Cup Line #5 was not guarded to prevent employee exposure.
