29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems. a) On or about July 28, 2018, employees were exposed to a fall of 49 inches while performing yearly shutdown maintenance on the air scrubber machine located on the roof of 34199 Curtis Blvd., Eastlake, Ohio 44095. The employees were working on all areas of the raised platform and the employer did not ensure that they were using fall protection. b) On or about October 28, 2018, a subcontractor's employees were exposed to a fall of 49 inches while performing repairs on the air scrubber located on the roof of 34199 34199 Curtis Blvd., Eastlake, Ohio 44095. The subcontractor's employees were working on all areas of the raised platform and the employer did not ensure that they were using fall protection.

29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems, as required by sub-items A through D of this section. a) On or about July 28, 2018, employees were exposed to a fall of 49 inches through a hole in a platform that was 39 inches wide by 39 inches long while performing yearly shutdown maintenance on the scrubber machine located on the roof of 34199 Curtis Blvd., Eastlake, Ohio 44095. b) On or about October 28, 2018, a subcontractor's employees were exposed to a fall of 49 inches while performing repairs on the air scrubber located on the roof of 34199 Curtis Blvd., Eastlake, Ohio 44095. The subcontractor's employees were working on all areas of the raised platform and the employer did not ensure that the employees were protected from falling through an unguarded hole in the platform.
