The employee was working in a trench with vertical walls in excess of 5 feet deep.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. a) On or about November 15, 2018, Gilbert Contracting, Inc. employee was exposed to a cave-in hazard while working in an unprotected trench that had not been evaluated for hazards by a competent person on site. The trench was approximately 5.5 feet to the top of the soil and 6.1 feet to the top of the concrete where the employee was digging a hole and required a protective system and ladder for egress.
