An employee working within an excavation approximately 5 feet 10 inches deep accessed the excavation to cut existing water lines without an adequate protective system. This condition exposed an employee to struck-by hazards associated with an excavation wall collapse.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a)H & W Contracting, L.L.C. at 5901 East Rice Street, Sioux Falls, SD 57110: On or about and at times prior to November 14, 2018, the exposing contractor did not ensure a competent person inspected the excavation prior to start of work and during each shift. The competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard regarding an employee that accessed the excavation to cut existing water lines. This condition exposed the employee to the hazard of working near the sides of an unprotected excavation.
