29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)H & W Contracting L.L.C. at Aspen Boulevard & Main Avenue, Brandon, SD 57005: On or about and at times prior to August 12, 2020 the employer did not ensure that employees conducting work in an excavation were protected from cave-in, in that the excavation was greater than five feet in depth and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed employees to struck-by hazards associated with a trench wall collapse. H & W Contracting L.L.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 652(a)(1) which was contained in OSHA inspection number 1407469, citation number 1, item number 1a and was affirmed as a final order on October 1, 2019 with respect to a workplace located at 69th Street & Medical Court Sioux Falls, SD 57107.
