29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill. On or about November 20, 2018 the employer did not ensure that trained employees and managers were provided with basic fall protection training that was understood and implemented. Flagging line used along the edge of the roof in lieu of standard railing exposed employees to fall hazards above 6 feet.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low sloped roofs, with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guard rail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: On or about November 20, 2018 the employer did not ensure that employees were provided with an adequate fall protection system. Flagging line used along the edge of the roof in lieu of standard railing exposed employees to fall hazards above 6 feet. The Weeks Roofing Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(B)(11), which was contained in OSHA inspection number 1217921, citation number 01, item number 001 and was affirmed as a final order on June 6, 2017, with respect to a workplace located at 9640 Montwood Dr., El Paso, TX 79928. The Weeks Roofing Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(B)(13), which was contained in OSHA inspection number 1101298, citation number 01, item number 001A and was affirmed as a final order on December 4, 2015 with respect to a workplace located at 991 Vereda Del Valle, El Paso, TX 79932.
