29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:   29 CFR 1910.147(c)(4)(ii)(B): Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.  a. 29 CFR 1910.147(e)(3): Lockout or tagout devices removal. Each lockout or tagout device shall be removed from each energy isolating device by the employee who applied the device. Exception to paragraph (e)(3): When the authorized employee who applied the lockout or tagout device is not available to remove it, that device may be removed under the direction of the employer, provided that specific procedures and training for such removal have been developed, documented and incorporated into the employer's energy control program. The employer shall demonstrate that the specific procedure provides equivalent safety to the removal of the device by the authorized employee who applied it. The specific procedure shall include at least the following elements:   29 CFR 1910.147(e)(3)(i): Verification by the employer that the authorized employee who applied the device is not at the facility:   29 CFR 1910.147(e)(3)(ii): Making all reasonable efforts to contact the authorized employee to inform him/her that his/her lockout or tagout device has been removed; and    29 CFR 1910.147(e)(3)(iii): Ensuring that the authorized employee has this knowledge before he/she resumes work at that facility.    a. On or before November 29, 2018, the employer's written hazardous energy control procedures for equipment including the Comco KB-70 bender (model: KB-70NS; S/N: K-02707-N) and Chiyoda SP-90 bender (model: SP-90S; S/N: 8507) did not include the following:  verification by the employer that the authorized employee who applied the device was not at the facility; making all reasonable efforts to contact the authorized employee to inform him/her that his/her lockout or tagout device had been removed; and ensuring that the authorized employee had this knowledge before he/she resumed work at that facility.

29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:      a. On or before December 19, 2018, the employer failed to ensure that employees who operated the Comco KB-70 bender (model: KB-70NS; S/N: K-02707-N) and Chiyoda SP-90 bender (model: SP-90S; S/N: 8507) and performed tooling changes including changing the pressure die, clamp die, bend die, and collet pads during set up were trained in the purpose and function of the energy control procedure and in the knowledge and skills required for the safe application, usage, and removal of the energy controls.

The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:   a. On or before November 29, 2018, the employer failed to ensure that employees who operated the Comco KB-70 bender (model: KB-70NS; S/N: K-02707-N) and performed tooling changes including changing the pressure die, clamp die, bend die, and collet pads during set up had the knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy; perform an orderly shutdown by completely shutting down the bender; isolate the bender from the energy sources; affix lockout or tagout devices to each energy isolating device; relieve, disconnect, restrain, and otherwise render safe all potentially hazardous stored or residual energy for the bender; and verify that isolation and deenergization of the bender had been accomplished.    b. On or before December 19, 2018, the employer failed to ensure that employees who operated the Chiyoda SP-90 bender (model: SP-90S; S/N: 8507) and performed tooling changes including changing the pressure die, clamp die, bend die, and collet pads during set up had the knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy; perform an orderly shutdown by completely shutting down the bender; isolate the bender from the energy sources; affix lockout or tagout devices to each energy isolating device; relieve, disconnect, restrain, and otherwise render safe all potentially hazardous stored or residual energy for the bender; and verify that isolation and deenergization of the bender had been accomplished.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.   a. On or before November 29, 2018, the employer failed to ensure that the point of operation including the pressure die, clamp die, bend die, and collet pads on the Comco KB-70 bender (model: KB-70NS; S/N: K-02707-N) was guarded during the complete operation cycle, thereby exposing employees to caught-in and struck-by hazards.      b. On or before December 19, 2018, the employer failed to ensure that the point of operation including the pressure die, clamp die, bend die, and collet pads on the Chiyoda SP-90 bender (model: SP-90S; S/N: 8507) was guarded during the complete operation cycle, thereby exposing employees to caught-in and struck-by hazards.  On or about September 10, 2018, an employee's right middle finger was crushed by the pressure die resulting in a broken finger and detachment of the fingernail tip due to getting caught in the die while operating the Chiyoda SP-90 pipe bender.   Appian Manufacturing Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(3)(ii), which was contained in OSHA inspection number 1262654, citation number 1, item number 1 and was affirmed as a final order on November 2, 2017, with respect to a workplace located at 2025 Camero Avenue, Columbus, Ohio 43207.

On or before December 19, 2018, the employer did not effectively conduct periodic lockout/tagout inspections to ensure that the energy control procedure and requirements of this standard were being followed by employees performing servicing and maintenance on machines and equipment throughout the facility.
