29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On 29 November 2018, two framers were installing plastic sheeting while elevated near the roof under construction without head protection, exposing the workers to the hazard of being struck by falling tools, materials, debris or the roof eave.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On 29 November 2018, two framers were installing weather-proof plastic sheeting on a McDonalds under construction from an elevated aerial lift basket without being tied-off, exposing both workers to a fall hazard of approximately 18 feet to the ground below. Felix Portillo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 992679, citation number 01, item number 003 and was affirmed as a final order on 10/03/2014, with respect to a workplace located at 6363 Farm to Market Road 78, San Antonio, TX 78244.
