29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety: (a) On or about November 28, 2018, and at times prior, for the employees exposed to cave-in hazards while installing utility lines in a trench approximately 11 feet deep where sheet piling was installed without an engineer approved design at or near 3210 Sheyenne Street in West Fargo, North Dakota.
