29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On June 24, 2019, for the employees exposed to cave-in and struck-by hazards while installing a man hole in an excavation approximately 7 feet in depth where protective systems were not used on a near vertical wall and an inadequately supported steel road plate was used on a different wall in the vicinity of 2125 Sheyenne Street in West Fargo, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1363476, Citation 1, Item 1a, and was affirmed as a final order on May 22, 2019, with respect to a workplace located at or near 3210 Sheyenne Street in West Fargo, North Dakota.
