29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways were not secured to prevent accidental displacement, or barricaded to keep the activities or traffic away from the ladder: On or about November 08, 2018, at a residential home located at 3413 Rocky River Dr., in Cleveland, OH, an employee placed a 32 ft. extension ladder in the driveway that was not secured and/or barricaded to prevent accidental displacement when accessing the upper landing surface located 10 (+) ft. above lower level. The employee was using the ladder to access the roof to install flashing around the chimney.

29 CFR 1926.1053(b)(15): Ladder(s) were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could have affected their safe use: On or about November 08, 2018, at a residential home located at 3413 Rocky River Dr., in Cleveland, OH, the extension ladder used to access the upper landing surface was not inspected prior to use. The ladder, which was being used by an employee tasked with installing flashing around the chimney; was defective in that, the left rung lock was missing which caused the ladder to tilt.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects were not immediately marked " Defective, Do not Use" and withdrawn from service: On or about November 08, 2018, at a residential home located at 3413 Rocky River Dr., in Cleveland, OH, the portable extension ladder was missing the left rung lock. The structural defect caused the ladder to tilt, potentially exposing an employee to a fall hazard. The defective ladder remained in service, and was not marked " Defective, Do not Use". The ladder was continuously used by an employee tasked with installing flashing around the chimney.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about November 08, 2018, during the installation of flashing around the chimney of a residential home located at 3414 Rocky River Dr. in Cleveland, Ohio, the employer failed to ensure that employees were protected from a fall hazard by conventional fall protection and/or devices. Employees were exposed to fall hazards from heights of approximately 10 (+) from the chimney area to the ground below. On Top Roofing and Renovations LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 1236018, citation number 1, item number 4 and was affirmed as a final order on August 06, 2018, with respect to a workplace located at 36409 Capri Ln., North Ridgeville, OH 44039.
