Roadrunner Construction Inc., failed to provide documentation demonstrating the abatement method and completion of the cited items.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  The employer is not maintaining fall safety programs to ensure employees are utilizing fall protection when exposed to fall hazards in excess of six feet.  This violation was most recently observed on December 17, 2018 at 130 S. Nicolet Rd. Appleton, WI 54914 where four employees were installing the top plates on top of steel beams while exposed to fall hazards of approximately 11 feet without any form of fall protection.  The company owner observed the fall hazards on December 17, 2018, and has continually observed fall hazards without maintaining a fall safety program to ensure employees follow the standards outlined in 29 CFR 1926 Subpart M.    To abate this violation, the employer must initiate and maintain a fall protection program that ensures employees utilize fall protection when exposed to fall hazards in excess of six feet.  This program shall include frequent and regular inspections by competent persons it designates, including the company owner, which ensures workers use appropriate safety measures.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including the names and qualification of the persons it designates as competent, a description of their responsibilities, and a description of a plan to ensure employees utilize safety measure such as a disciplinary program.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide a fall safety training program for employees exposed to fall hazards while engaged in carpentry work.  On December 17, 2018, four employees were observed exposed to fall hazards of approximately 11 feet without any form of fall protection while installing top plates on top of steel beams for a new hotel located at 130 S. Nicolet Rd. Appleton, WI 54914.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  The employer did not provide a training program for employees utilizing portable ladders while engaged in carpentry work.  On December 17, 2018, an employee was observed working on the second to top step of a Werner 10 foot self-supporting fiberglass ladder while installing hanger brackets located at 130 S. Nicolet Rd. Appleton, WI 54914.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about December 17, 2018, employees working at 130 S. Nicolet Rd. Appleton, WI 54914 were exposed to fall hazards of approximately 11 feet without any form of fall protection while installing wood top plates on steel beams during wood framed construction of a new hotel.

29 CFR 1926.403(b)(1): Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined on the basis of the considerations found in 29 CFR 1926.403(b)(1)(i) through 29 CFR 1926.403(b)(1)(vii):  The employer did not examine electrical equipment including extension cords for recognized hazards.  On or about December 17, 2018, several cord sets located at 130 S. Nicolet Rd. Appleton, WI 54914 were observed with damaged insulation and missing ground pins.
