29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Roadrunner Construction, Inc. at 545 Northern Lights Boulevard, Apartment B, Box Elder, SD 57719: On or about and at times prior to April 27, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting roofing operations on a multi-family residential property without the use of a fall protection system and were operating nail guns with a lack of Personal Protective Equipment (PPE). This condition exposed subcontracted employees to fall, body impalement, and struck-by hazards. Roadrunner Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1366593, citation number 1, item number 1a, and was affirmed as a final order on January 22, 2019, with respect to a workplace located at 130 South Nicolet Road, Appleton, WI 54914.
