29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, shall not be used on top of scaffold platforms to increase the working level height of employees.    On December 19, 2018, at 403 E. Court St. Washington Court House, a Sonic restaurant under construction an employee in a mobile scissors lift was exposed to a 10 ft. fall hazard by both feet standing on the midrail of the metal guardrail system while securing the metal roof sections that were covered the overhang.

29 CFR 1926.451(g)(4)(iii): When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they shall be installed between the top edge of the guardrail system and the scaffold platform.    On December 19, 2018, at 403 E. Court St. Washington Court House, a Sonic restaurant under construction, a employee working in a mobile scissors lift was exposed to a 10 ft. fall hazard due to the chain midrail not connected to the end of the platform sides of the guardrail system.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.    On December 19, 2018, at 403 E. Court St. a Sonic restaurant under construction, the employer had not provided a fall protection system for an employee prior to an employee started working on the parking roof overhang to complete weather proof work on the overhang.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    On December 19, 2018, at 403 Court St. Washington Court House, a Sonic restaurant under construction, an employee was exposed to a 9 ft. fall hazard while performing work on the parking roof overhang without utilizing any form of fall protection.    R&M Fabricators, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1926.501(b)(1), which was contained in OSHA inspection number 1235492, citation number 1, item number 1, and was affirmed as a final order on June 30, 2017, with respect to a workplace located at 3201 Paris Road, Chalmette, LA 70043.
