OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazards due to using a below-the-hook lifting device without the proper markings, construction, and installation:  a) Warehouse - On or prior to December 4, 2018, employees were exposed to struck-by hazards when working around a below-the-hook lifting device (spreader bar made in-house) that was not tested or load rated.   The below-the-hook lifting device is used to lift approximately 600-1500 lb walls and did not have any markings.
