29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof. This most recently occurred on January 7, 2019 on the jobsite located at 17940 Camden Ave, Elkhorn, NE 68022. Two employees were observed using hand-held pneumatic nail guns to frame a newly constructed residential home without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on January 7, 2019 on the jobsite located at 17940 Camden Ave, Elkhorn, NE 68022. Six employees were installing trusses on a newly constructed residential home and not utilizing any form of fall protection. The ground to top plate height where employees were working is approximately ten feet. Ramirez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1069808, citation number 1, item number 3, and was affirmed as a final order on October 8, 2015 with respect to a workplace located at 9133 Summit St., Omaha, NE 68110.
