On or about July 29, 2021, at the gas station located located at 1225 N Hill Road, Pickerington, Ohio, the employer failed to instruct each employee in the avoidance of unsafe conditions while performing construction activities on the gas station roof.  b. On or about July 29, 2021, at the oil change center located at 1225 N Hill Road, Pickerington, Ohio, the employer failed to instruct each employee in the avoidance of unsafe conditions while performing construction activities on the oil change facility roof.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a. On or about July 29, 2021, at the gas station located located at 1225 N Hill Road, Pickerington, Ohio, employees were performing roofing work on a one story commercial building with a pitch of approximately 6 in 12 and approximately 13 feet in height without fall protection, thereby exposing the employees to a fall hazard.  b. On or about July 29, 2021, at the oil chance center located at 1225 N Hill Road, Pickerington, Ohio, employees were performing roofing work on a one story commercial building with a pitch of approximately 6 in 12 and approximately 13 feet in height without fall protection, thereby exposing the employee to a fall hazard.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about July 29, 2021, at the front of the gas station located located at 1225 N Hill Road, Pickerington, Ohio, the employer did not ensure the ladder side rails extended at least 3 feet above the upper landing surface to which the ladder was used to gain access exposing employees to fall hazards of approximately 13 feet.  b. On or about July 29, 2021, at the back of the gas station located located at 1225 N Hill Road, Pickerington, Ohio, the employer did not ensure the ladder side rails extended at least 3 feet above the upper landing surface to which the ladder was used to gain access exposing employees to fall hazards of approximately 13 feet.  c.
