29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) Facility, 504 White Birch Road, Hazle Township, PA - Employees operated four (4) forklifts (Toyota Model 42-6FGCU25, Toyota Model 8FGCU32, Mitsubishi Model FGC25N, and JLG Telehandler Model 100548) to transport bales of plastic and material without having received documented and certified formal instruction, practical training and/or an evaluation thereby exposing themselves and other employees to struck-by hazards, as observed on or about January 11, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, the date of evaluation, and the identity of the person(s) performing the training and/or evaluation. a) Facility, 2211 Memorial Highway, Dallas, PA - Employees operated four (4) forklifts (Toyota Model 42-6FGCU25, Toyota Model 8FGCU32, Mitsubishi Model FGC25N, and JLG Telehandler Model 100548) on a daily basis without certification as to having received formal training, practical training and/or evaluation exposing themselves and other employees to struck-by hazards, on or about January 11, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for the violation.
