29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system.    On or about January 4, 2019 an employee was performing cleaning activities on top of the vessel known as the let tank. The employee fell approximately 9 feet 7 inches to the ground resulting in hospitalization. The employer did not provide protection for the employee being exposed to falls from unprotected edges.      Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section.    On or about, January 2, 2019 through February 26, 2019 on five occasions, employees were cleaning out tanks and the employer did not develop, document, and utilize procedures when the employees were performing cleaning activities. Employees were exposed to electrical, thermal, and engulfment hazards on the following tanks:        a.  LM MIX TANK            b. New Tank Mix            c. LMP Mix Tank                d. New MEL ROL LET TANK            e. MIX Tank

29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:    (A)  Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  (B)  Each affected employee shall be instructed in the purpose and use of the energy control procedure.  (C)  All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.    On or about January 2, 2019 through February 26, 2019 on five occasions employees were cleaning out tanks. The employees had not received training in the function of the energy control program, and the safe application, usage and removal of energy controls for hazardous energy sources. Employees were exposed to amputation, thermal and engulfment hazards while cleaning tanks.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee did not affix a personal lockout or tagout device to the group lockout device before working on the machine or equipment:    On or about January 2, 2019 through February 26, 2019 on five occasions employees who were cleaning out tanks did not affix a lock along with the maintenance employees. Employees were exposed to unexpected startup of the mixer/tank because they did not have control of the energy sources.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
