Citations Amended to: 29 CFR 1910.178(l)(6): certification that each operator has been trained and evaluated as required by paragraph (l) is required. The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. 29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: JOB SITE: 478 Pearl Drive, O Fallon, MO 63366, on or about 1/15/2019, the employer fail to provide refresher training after a forklift operator had an accident and a near miss incident with a forklift within weeks of each other. A third incident occurred on January 10, 2019, when the forklift operator struck a tugger operator with the forklift.
