The employer did not conduct periodic inspections of their energy control procedures including the Messer CNC Laser, Controlled Automation, Inc. CNC Punch press, Standard Industrial Corp. Hydraulic Press Brake, Marvel Manufacturing Company, Inc. 2125A-PC3S automated band saw, and Iron worker among others when employees are performing servicing and maintenance tasks.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. Employees operating the Marvel 2125A-PC3S automated metal band saw were exposed to an unguarded automatic infeed clamping mechanism which created pinch points and potential struck by hazards.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. (a) A Standard Industrial Corp. Model AB325-02 Hydraulic Brake Press located in the fabrication building was not provided any form or guarding to prevent employees from accessing the point of operation during the operating cycle exposing employees to pinch points. (b) A Controlled Automation, Inc. Model ABL-86T-FXP CNC Punch press located in the fabrication building was not provided any form of guarding to prevent employees from accessing the point of operation during the operating cycle exposing employees to pinch points from the hold down and shear. (c) A Uni-Hydro Ironworker located in the fabrication building was not provided any form of guarding to prevent employees from accessing the point of operation during the operating cycle for the punch exposing employees to pinch points.

29 CFR 1910.243(c)(1): General requirements. Abrasive wheels shall be used only on machine provided with safety guards as defined in paragraph (c) (1) through (4) of this section. On or about February 11, 2019, employees located in the welding shop utilized portable 7 inch and 9 inch angle grinders with the guards removed.
