29 CFR 1910.252(b)(2)(i)(A): Helmets or hand shields shall be used during all arc welding or arc cutting operations, excluding submerged arc welding. Helpers or attendants shall be provided with proper eye protection. On or about October 26, 2021, in the Fabrication Area, employees performing initial tack welds were not utilizing helmets or hand shields exposing employees to eye injuries.

29 CFR 1910.252(b)(2)(iii): Protection from arc welding rays. Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black, or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles. On or about October 26, 2021, in the Fabrication Department, welding screens were not utilized when workers were working adjacent to welding operations exposing employees to flash hazards.

29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. (a) On or about October 11, 2021, the Uni-Hydro, Inc. Ironworker (Model: 120-24, S/N: 3P120117X) had the bender and angle shear sections which were unguarded exposing employees to caught between and pinch hazards. The Nimsgern Steel Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1378018, citation number 1, item number 3 and was affirmed as a final order on August 1, 2019, with respect to a workplace located at 8765 Frank Drive in Minocqua, Wisconsin.
