OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to struck by hazards: a) Raw Ingredients / Receiving Room: On February 14, 2019 and at times prior employees were exposed to struck by hazards while loading and unloading materials on the damaged steel storage racking.

29 CFR 1910.29(b)(13): Guardrail systems were not used around holes that serve as points of access (such as ladderways), the guardrail system opening did not contain a self-closing gate that slid or swung away from the hole and was equipped with a top rail and intermediate rail; or contained an offset guardrail system to prevent employees from falling: a) Freezer 1: On or about February 14, 2019 and at times prior employees were exposed to fall hazards of approximately 9 feet while working in and around the ladder access point. b) Yeast Box: On or about February 14, 2019 and at times prior employees were exposed to fall hazards of approximately 9 feet while working in and around the ladder access point. c) Bun Oven: On or about February 14, 2019 and at times prior employees were exposed to fall hazards of approximately 7 feet while working in and around the ladder access point.
