29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:   a)  16 Silver Terrace - On or about February 27, 2019 and at times prior thereto, the work site was covered in scrap lumber with protruding nails, unused coils of nails, and various pieces of lumber throughout the area where employees were working.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) 16 Silver Terrace - On or about February 27, 2019 and at times prior thereto, employees were laying underlayment paper on a steep sloped roof with at least one not using personal fall protection.   On February 27, 2019 an employee was fatally injured when he fell from the back side of the roof onto a piece of plywood lying on the ground.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a) 16 Silver Terrace - On or about February 27, 2019 and at times prior thereto, employees were laying underlayment paper on a steep sloped roof with at least one of them not wearing personal fall protection.  The employer did not provide all of the employees with training to recognize and minimize fall hazards.  On February 27, 2019 an employee was fatally injured when he fell from the back side of the roof onto a piece of plywood lying on the ground.
