29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a- CSHO observed employees engaged in roof shingle removal activities on a lower roof are exposed to an overhead impact hazard from an employee on the upper roof as head protection is not being utilized. Condition observed on or about 08/04/2022.  b- CSHO observed an employee engaged in the directing of employees roofing activities at ground level are exposed to an overhead impact hazard from removed roof shingles hanging over the roof edge as head protection is not being utilized. Condition observed on or about 08/04/2022.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels  is not protected by guardrail systems, safety net system, or personal fall arrest system.  a-ALJ Home Improvement Inc does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 08/04/2022, at 514 Warren Ave, Ho-Ho-Kus, NJ/Roof. Employee #1 was engaged in the removal of roofing shingles on a 6 on 12 pitch roof using a pry bar and was not protected from fall hazards of approximately 18 ft to the asphalt below.   Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of fall protection provided and the steps taken to enforce use of appropriate fall protection where employees are exposed to possible danger of fall hazards.

29 CFR 1926.1053(b)(1): Where portable ladders are used for access to upper landing surfaces, the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders are used to gain access, and where such extension is not possible because of the ladder's length, the employer fails to secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder.    a-ALJ Home Improvement Inc does not ensure that when it uses a portable ladder for access to upper landing surfaces, that the side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access, and when such extension is not possible because of the ladder's length, fails to secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder. This violation was most recently observed, on or about August 4, 2022, at 514 Warren Ave, Ho-Ho-Kus NJ 07423: Employees engaged in roofing activities were using a Werner extension ladder to access a roof and were exposed to fall hazards of approximately 12ft to the asphalt below in which the ladder side rails did not extend 3 feet (.9 m) above the upper landing surface and the employer did not secure the ladder at its top to a rigid surface that will not deflect, and provide a grasping device to assist employees in mounting and dismounting the ladder.   Pursuant to 29 CFR 1903.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including an abatement plan and the steps taken to enforce compliant use of portable ladders
