29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about February 27, 2019, located at 6781 Morningside Heights (Lot 47) in Westerville, Ohio, the employer did not initiate and maintain safety and health programs for employees installing siding on the exterior of a residential home from scaffolding, when climbing extension ladders, operating portable saws, etc. exposing the employees to fall and struck-by hazards.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a. On or about February 27, 2019, located at 6781 Morningside Heights (Lot 47) in Westerville, Ohio, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the regulations applicable to siding installation on the exterior of a residential home from scaffolding, when climbing extension ladders, operating portable saws, etc. exposing the employees to fall and struck-by hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about February 27, 2019, located at 6781 Morningside Heights (Lot 47) in Westerville, Ohio, an employee was installing siding while on a steep-pitched roof on a residential home without fall protection, thereby exposing the employee to a maximum fall hazard of approximately 20 feet.    Juan Montoya was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1203235, citation number 1, item number 1a, and was affirmed as a final order on February 15, 2017, with respect to a workplace located at 11508 Glencrest Drive NW Pickerington, Ohio 43147.
