The employer failed to initiate and maintain a personal protective equipment and fall protection program that addressed the identification or prevention of struck-by and fall hazards.

The employer did not ensure that the Alum-A-Pole pump-jack scaffold system onsite was inspected for visible defects by a competent person before employee use. The supported scaffold had visible defects such as but not limited to damaged platform, unlevel and unsound footings, damaged rear mesh and missing end/mid rails.
