29 CFR  1926.451(c)(2)(i):Footings shall be level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement.  a. On or about May 23, 2023, located at 102 Cedarhurst CT Lot 42 LH, Pickerington, Ohio, the employer did not ensure employees were protected from fall hazards while using a pump jack scaffold with a footing that was not level exposing employees to an approximate 12 foot fall hazard.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. On or about May 23, 2023, located at 102 Cedarhurst CT Lot 42 LH, Pickerington, Ohio, the employer did not ensure employees were protected from fall hazards while using a pump jack scaffold without railings on the ends or a personal fall arrest harness, exposing employees to an approximate 12 foot fall hazard.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about May 23, 2023, located at 102 Cedarhurst CT Lot 42 LH, Pickerington, Ohio, the employer did not ensure employees were protected from fall hazards while using the porch roof of a two-story single family home to perform siding work exposing employees to an approximate 12 foot fall hazard.  Juan Montoya was previously cited for a violation of this Occupational Safety and Health standard  29 CFR  1926.501(b)(13), which was contained in OSHA Inspection number 1382098, citation number 2, item number 1 and was affirmed as a final order on April 15, 2019, with respect to a workplace located at 6781 Morningside Heights (Lot 47) in Westerville, Ohio.
