29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The employer failed to train employees that were potentially exposed to fall hazards to enable each employee to recognize the hazards associated with the type of work being conducted. This should include training on mitigating those hazards through an acceptable method of fall protection. Training should also include the requirements for fall protection systems and when it is appropriate to utilize those systems. This was identified on March 18, 2019 at a residential home construction site at 1620 Pennsylvania Ct, Lincoln NE.

29 CFR 1926.102(a)(2): Eye and face protective equipment being used did not used meet the requirements specified in Z 87.1-1968. The employer is failing to protect employees from struck-by hazards associated with using pneumatic nail guns without wearing approved eye protection. The most recent occurrence of this was observed on March 18, 2019 at a residential home construction site at 1620 Pennsylvania Ct, Lincoln NE where the employer has employees using pneumatic nail guns to secure the shingles they were installing on the roof without wearing any ANSI approved eye protection. Oswaldo Ontiveros was previously cited for a violation of this occupational safety and health standard or its equivalent 29 CFR 1926.102(a)(2), which was contained in OSHA inspection number 1332470, citation number 1, item number 1, was affirmed as a final order on August 16, 2018 with respect to a workplace located at NE Corner of 207th St and E St, Elkhorn, NE 68022.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system. The employer is failing to ensure that all employees exposed to fall hazards while shingling a roof are utilizing fall protection. This most recently occurred on February 18, 2019 on the jobsite located at 1620 Pennsylvania Ct, Lincoln, NE 68521. Three employees were observed sheeting the roof of a one-story residential building at heights greater than six feet above the ground while not utilizing any form of fall protection. Oswaldo Ontiveros was previously cited for a violation of this occupational safety and health standard or its equivalent 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1356952, citation number 1, item number 1, was affirmed as a final order on December 13, 2018 with respect to a workplace located at 7267 N 172nd St, Bennington, NE 68007. Oswaldo Ontiveros was also previously cited for a violation of this occupational safety and health standard or its equivalent 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1332470, citation number 1, item number 2, was affirmed as a final order on August 16, 2018 with respect to a workplace located at NE Corner of 207th ST and E St, Elkhorn, NE 68022.
