29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection.  This most recently occurred on March 18, 2019 on the jobsite located at 7656 Von St, Papillion, NE 68046.  Two employees were re-roofing a two-story residential house and not utilizing any form of fall protection.  The house has an eight in twelve steep sloped pitch and ground to eve height is approximately eleven feet.       Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.    The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314057225, citation number 1, item number 1, and was affirmed as a final order on November 25, 2015 with respect to a workplace located at 5401 N 155th St., Omaha, NE 68116.     The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1007101, citation number 2, item number 1, and was affirmed as a final order on March 26, 2018 with respect to a workplace located at 2469 182nd Cir., Omaha, NE 68130.     The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1127759, citation number 1, item number 1, and was affirmed as a final order on April 3, 2017 with respect to a workplace located at 6611 S. 200th Ave, Omaha, NE 68135.      The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1163496, citation number 1, item number 1, and was affirmed as a final order on April 12, 2017 with respect to a workplace located at 2202 176th St, Elkhorn, NE 68122.    The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1335198, citation number 2, item number 1, and was affirmed as a final order on January 16, 2019 with respect to a workplace located at Cove Hollow Cir, Lot 33, Papillion, NE 68046.    The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1349124, citation number 1, item number 1, and was affirmed as a final order on January 16, 2019 with respect to a workplace located at 19256 Ames Cir, Omaha, NE 68116.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.   The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof.  This most recently occurred on March 18, 2019 on the jobsite located at 7656 Von St, Papillion, NE 68046.  One employees was observed using a hand-held pneumatic nail gun to install roofing material without any form of eye or face protection.      Francisco Esquivel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1335198, citation number 1, item number 1, and was affirmed as a final order on January 16, 2019 with respect to a workplace located at Cove Hollow Cir, Lot 33, Papillion, NE 68046.
